longf how does it take to get workman comp settlement documents filed and forwarded to your lawyer.?
I have already said I wanted to settle. Medicare then wanted have workman comp set aside money for future medical expenses. two months later, we had a court date today. since everything is supposed to be resolved, how long before I can expect to get the papers to sign saying I'll pay?
workman comp is a nightmare. the fund must include and investigate the medical expenses future. third party insurance claims always take some time but are paid more. if there was a court date for today I would not be surprised if you have the paper in two weeks.

Is it illegal for an employer to dismiss an employee rather than open a claim for workers?
I started a new job and after I hurt my foot on the job, was told not to return to work. It proved to be a problem minor anyway, but I'm very upset I lost my job over this incident. Are there any legal action can I take? Another thing that concerns me is that this is a very large company, and they would not document the incident at all. However, I worked for 2 1 / 2 weeks
If you were injured on the job that you have some protection. However, if the employer believed the injury is due to non compliance with procedures or not to use safety measures, you can be fired legally. However, should your medical expenses be covered.

My husband went before arbitrator in case of compensation of workers in his May We are still waiting to hear something. Our lawyer once said it looks good and gives us the next day all worried that this will go the other way. He was wounded at his post where he broke two ribs, chest, and severed two disc in his back. Lost job and can no longer work in manual labor and we are still waiting to hear that we can move forward with the back surgery. Does anyone know how long it might take. I mean, I testified, doctors, my mother-in-law all before the arbitrator and we're just waiting on his decision. Why is it taking so long? Any that advice?
It's strange that your lawyer does not agree with you why he thinks it could go the other. Call it and ask him. Anyway, if it drags you might want to change lawyers. It can drag on for long because there are so money is involved. The insurance company business could be to try to muck it up.Even if it does not go your way, you can appeal. Your husband will need money for medical expenses, money to maybe go back to school, and all sorts of damage. Insurance comanies often send someone to obtain proof that a person is actually disabled, even after their establishment. If they pay out $ 200,000 dollars, it is worthwhile for them to spend 2000 to do so. They catch the guy who got the big money, but foolishly started work side jobs ……. so that any losing and be sued and charged w. fraud. So no more racing lifting, running stairs, dancing, etc.

What kind of lawyer should I search for that deals with unmarried couples?
Hi, the thing is that me and my boyfriend bought a house, car and pay bills together. We broke up a while ago, and I was wondering what kind of lawyer I could look for that can help me with the legal matters of the house, since we’re both on the loan together, and I would like to put the house for sale or get out of the loan, since I don’t trust him; and for the car and stuff.
We were together for four years.
And I don’t really want us to sell the house and him keeping all the money, or him keeping the car (because his name is on the loan with mine, and I pay the car monthly)

ANYONE! ! know of a lawyer that specializes in worker’s compensation against Albertson’s in the bay area?
I know of someone who uses there hands in their job for the Union. Two moths ago they broke their hand while working and took a few days off from that. They went to see the Union Dr. and was told to go back to work, just not to use the injured hand. Of course when they go back to work, they have to use both hands to do their job. They started working shorter shifts, and going home in major pain. The boss’s of this person would complain about their performance.
Now almost two months have gone by. This person went back to the WC Dr., and said that they needed to have an x-ray or mri, because something is not healing right in the hand. The doctor said maybe in two-three weeks. The doctor will not put this person on leave and in the meantime this person is losing a ton of money from not working, fears loss of job.
Does anyone know of any good Lawyer? Even if we have to take a loan out for this. San Jose, Sunnyvale, Cupertino, Campbell, Mountain View, Palo Alto or anywhere around….?
The union should be able to recommend someone.

Does anyone know if a drug test is necessary to qualify for Workman’s Comp or disability?
I was injured at work and taken to the hospital. I was told that I would need to go through a workman’s comp doctor, but a few weeks ago someone had slipped something into my drink at a bar. I was just worried that I might fail a drug test if given one, and I don’t want to risk losing my job.
Anytime you are injured at work a drug screen is done when you go to the hospital or doctor. If you test positive, your employer will know and likely fire you. Also work comp will not pay if you were under the influence.
